Terms of Use

These Terms of Use ("Terms") are the agreement between you and Weathertop Studios for access to and use of MiTRYBE. MiTRYBE is a Florida-first matching layer for people, places, and products, beginning with questions, a preference map, and seed recommendations. Our thesis is Don't guess. Ask. These Terms ask you plainly to use the product lawfully, accept early-product limitations, and read related policies that explain accounts, privacy, maps, and community expectations.

By accessing or using MiTRYBE, creating an account, or continuing after we post updates, you agree to these Terms and to the Privacy Policy, Accounts Policy, Community Standards, and other policies linked from /learn/policies. If you do not agree, do not use MiTRYBE.

1. Purpose and parties

Weathertop Studios provides MiTRYBE as software and related content. You are the individual using the service. These Terms govern the relationship for that use. They do not make you an employee, partner, or agent of Weathertop Studios. They do not sell you ownership of MiTRYBE source code, brands, or question banks.

2. Scope of the service

MiTRYBE currently emphasizes single-player onboarding, structured questions, a revisable preference map, feature unlocks tied to answered dimensions, and early Florida seed recommendations with because-clauses. Authentication may use Firebase Authentication. Profiles may sync through Firestore when you sign in. Local browser storage may keep a working profile under keys such as mitrybe-profile-v2.

Features that appear greyed out may be waiting on your answers or on product maturity. Live multi-user matching, advertising marketplaces, and statewide live venue databases may not exist yet. We will not pretend they do. When new features launch, additional terms or policy updates may apply.

3. Eligibility

You must be able to form a binding contract where you live. MiTRYBE is not directed to children under 13. If you are between 13 and the age of majority, you may use MiTRYBE only with parental or guardian permission and acceptance of these Terms. You may not use MiTRYBE if Weathertop Studios has terminated your account for violations or if applicable law prohibits your use.

4. Accounts and credentials

Account creation, usernames, suspension, and closure are detailed in the Accounts Policy, which is incorporated by reference. You are responsible for credentials and for activity under your account. Notify us of unauthorized access through Contact Us. Weathertop Studios may refuse registration, reclaim names, or terminate access as described in Accounts and Community Standards.

5. Preference maps and user content

When you answer questions, you provide content that builds a preference map. Ownership, reset rights, and unlock rules are described in the Preference Map Policy. You grant Weathertop Studios a worldwide, non-exclusive license to host, process, display back to you, and otherwise use your answers and derived map data to operate and improve MiTRYBE. We will not sell your preference map as a standalone product.

You represent that you have the right to submit the answers you provide and that your submissions do not violate law or third-party rights. You must not submit illegal content, malware, or material that violates Community Standards.

6. Acceptable use

You agree not to:

• Violate law, these Terms, Community Standards, or other MiTRYBE policies.
• Harass, threaten, stalk, scam, or exploit other people.
• Attempt unauthorized access to systems, accounts, or data, including probing beyond ordinary use.
• Scrape, bulk-export, or harvest data at abusive volumes, especially other users' information if social features appear.
• Interfere with service integrity, including denial-of-service behavior or circumventing rate limits and unlock logic through abusive automation.
• Misrepresent affiliation with Weathertop Studios or MiTRYBE.
• Use MiTRYBE to build a competing preference model by systematically misusing our question flows or outputs in breach of these Terms.

Weathertop Studios may investigate and enforce with warnings, suspensions, terminations, or technical blocks. Security practices are summarized in the Security Policy.

7. Recommendations disclaimer

Early Florida recommendations are seed archetypes with because-clauses—not a live venue database and not a guarantee. Always use your own judgment for safety, accessibility, and dietary needs. Full detail lives in the Recommendations Policy. Third-party places are independent; your visits and purchases are at your own risk.

8. Intellectual property

MiTRYBE branding, UI, question design, software, and editorial seed content are owned by Weathertop Studios or its licensors. You may not copy, modify, distribute, reverse engineer (except to the limited extent allowed by law), or create derivative works from our non-user materials without permission. "MiTRYBE," Weathertop Studios marks, and related logos may not be used in a way that confuses the public about source or endorsement.

Feedback you send—ideas for questions, bugs, or copy—may be used by Weathertop Studios without obligation to compensate you. Do not submit feedback you do not want us to use.

9. Third-party services

MiTRYBE relies on providers such as Google Firebase Authentication, Firestore, and hosting vendors. Outbound links may send you to maps, venues, or other sites. Third-party terms and privacy policies apply to those services. Weathertop Studios is not responsible for third-party acts or omissions beyond obligations law imposes and that we cannot disclaim.

10. Disclaimers

MITRYBE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW. WEATHERTOP STUDIOS DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT THE PREFERENCE MAP WILL PERFECTLY REFLECT YOUR TASTE ON EVERY DAY IN EVERY CONTEXT.

MiTRYBE is not medical, legal, dietary, accessibility, or emergency advice. Florida weather, travel, and venue conditions require your independent judgment. Alignment features, when launched, are not a promise of friendship, employment, romance, or safety.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WEATHERTOP STUDIOS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF MITRYBE OR FROM RELIANCE ON RECOMMENDATIONS, MAPS, OR MATCHING FEATURES. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO MITRYBE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNTS YOU PAID TO WEATHERTOP STUDIOS FOR MITRYBE ACCESS IN THE TWELVE MONTHS BEFORE THE CLAIM—IF ANY.

Some jurisdictions do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted.

12. Indemnity

You agree to defend, indemnify, and hold harmless Weathertop Studios and its people from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your misuse of MiTRYBE, your user content, your violation of these Terms or Community Standards, or your violation of others' rights—except to the extent caused by Weathertop Studios' willful misconduct where law does not allow indemnity.

13. Florida-first context and governing law

MiTRYBE is built with Florida as the first experimental field. Product copy may reference statewide patterns without implying we provide governmental services. Unless mandatory law says otherwise, these Terms are governed by the laws of the State of Florida, excluding conflict-of- law rules. Venue for disputes that proceed in court shall lie in state or federal courts located in Florida, and you consent to personal jurisdiction there, subject to any rights you have under non-waivable consumer protections in your place of residence.

Weathertop Studios prefers to resolve issues informally first. Contact /contact or support@mitrybe.com before filing a claim when practical.

14. Changes, suspension, and termination

We may modify MiTRYBE features at any time, including discontinuing early experiments. We may update these Terms by posting a revised version with a new "Last updated" date. Material changes will be reflected on this page; continued use after the effective date constitutes acceptance where permitted by law. If you disagree, stop using MiTRYBE and request account closure.

We may suspend or terminate access for violations, risk, or operational reasons. You may stop using MiTRYBE at any time. Provisions that by nature should survive (including intellectual property, disclaimers, limitations, indemnity, and governing law) survive termination.

15. Miscellaneous

These Terms, plus incorporated policies, are the entire agreement on the subject matter and supersede conflicting prior understandings regarding MiTRYBE use. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset transfer. Section titles are for convenience only.
